Terms and Conditions

Effective date: 10 December 2025

These Terms and Conditions (“Terms”) govern your use of the BioG website and your purchase of products from BioG (“BioG”, “we”, “us”, “our”). By accessing or using our website, you agree to be bound by these Terms. If you do not agree, you must not use our website or purchase our products.

  1. About us
BioG is an online store offering beauty and related products to customers in the European Union and the United Kingdom.
Company name: BioG (replace with full legal entity name)
Registered address: [Insert full business address]
Email: info@biog.local (replace with your real email)

  2. Eligibility
By using our website and placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract in your country of residence.

  3. Use of the website
You agree to use our website only for lawful purposes and in accordance with these Terms. You must not:

  • Use the website in any way that violates applicable law.

  • Attempt to gain unauthorised access to any part of the website or our systems.

  • Interfere with or disrupt the website or servers.

We may suspend or terminate your access if we reasonably believe that you have breached these Terms.

  1. Account registration
To place certain orders or access specific features, you may need to create an account. You must provide accurate and complete information and keep your login details confidential. You are responsible for all activities that occur under your account. Notify us immediately if you believe your account has been compromised.

  2. Products and availability
Product descriptions, images, prices, and availability are provided on our website. We make reasonable efforts to ensure that information is accurate, but minor variations in colour, packaging, or appearance may occur. We reserve the right to change or discontinue products at any time.

  3. Prices, taxes and currency
All prices displayed on the website are shown in [insert currency, e.g. EUR/GBP] and include applicable VAT or sales tax where required by law, unless stated otherwise. Additional charges such as delivery costs are shown separately before you place your order.

We may change prices at any time, but such changes will not affect orders already accepted by us.

  1. Orders and contract formation
When you place an order, you make an offer to purchase the selected products in accordance with these Terms. The steps are:

  1. You add products to your cart and proceed to checkout.

  2. You provide the required information and confirm your order.

  3. You submit your order and make payment.

  4. We send you an order confirmation by email; this is an acknowledgement that we have received your order.

The contract between you and BioG is formed when we send you an email confirming that your order has been accepted and dispatched. We may refuse or cancel an order before dispatch, for example if:

  • The product is out of stock.

  • There is an error in price or description.

  • We cannot obtain authorisation for your payment.

  • We reasonably suspect fraud or misuse.

If we cancel an order after payment is received, we will refund the full amount you paid for that order.

  1. Payment
We accept the payment methods indicated at checkout, which may include credit/debit cards, online payment services, or other local methods. Payment must be made in full at the time of order.

Payments are processed through secure third‑party payment processors; we do not store your full card details. Your bank or payment provider may apply additional fees or currency conversion charges beyond our control.

  1. Delivery

9.1 Delivery areas
We deliver to the countries listed at checkout, including EU Member States and the United Kingdom, unless otherwise stated.

9.2 Delivery times
Estimated delivery times and options are shown during checkout and in your order confirmation. These are estimates only; actual delivery times may vary due to factors beyond our control such as customs checks, carrier delays, or local holidays.

9.3 Delivery costs
Delivery charges are shown separately before you confirm your order. Any import duties, customs fees, or local taxes (where applicable) are your responsibility unless we explicitly state otherwise at checkout.

9.4 Risk and ownership
Risk of loss or damage to the products passes to you when they are delivered to the delivery address you provided. Ownership of the products passes to you once we have received full payment for all sums due in respect of the products, including delivery charges.

  1. Right of withdrawal (EU and UK consumers)

If you are a consumer in the EU or UK, you generally have a statutory right to withdraw from a distance contract within 14 days without giving any reason, subject to legal exceptions.

10.1 Withdrawal period
The withdrawal period is 14 days from:

  • The day you, or a third party indicated by you (other than the carrier), receive the products; or

  • In the case of multiple products ordered in one order and delivered separately, the day the last item is delivered.

10.2 How to exercise the right of withdrawal
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by a clear statement (e.g. letter by post or email). Please include your name, address, order number, and details of the products. You may, but are not obliged to, use any model withdrawal form provided under local law.

10.3 Effects of withdrawal
If you withdraw from the contract within the withdrawal period, we will refund all payments received from you for the products, including standard delivery costs (if any), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision.

We may withhold the refund until we have received the products back or you have supplied evidence of having sent them back, whichever is earlier.

10.4 Return of products
You must send back the products or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. You will bear the direct cost of returning the products, unless we expressly agree otherwise.

You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics, and functioning (similar to how you would examine goods in a shop).

10.5 Exceptions to the right of withdrawal
The right of withdrawal may not apply to certain products, for example:

  • Sealed goods not suitable for return due to health protection or hygiene reasons once unsealed after delivery (such as certain beauty or cosmetic products).

  • Goods made to your specifications or clearly personalised.

  • Goods which are liable to deteriorate or expire rapidly.

Where such legal exceptions apply, we will inform you before you place your order.

  1. Returns, refunds and exchanges (contractual policy)
In addition to statutory rights, we may offer a contractual returns or exchange policy; if so, its conditions will be described on the website or in your order confirmation. Any such policy does not limit your mandatory consumer rights.

  2. Product defects and non‑conformity
If a product is defective or does not conform to the contract, you may be entitled to repair, replacement, price reduction, or refund in accordance with applicable consumer law. Please contact us as soon as reasonably possible with details and, if requested, photos of the issue.

  3. Promotional offers and discount codes
From time to time, we may offer promotions, discount codes, or special offers. Each promotion may be subject to additional terms, such as eligibility criteria, validity periods, and usage limits, which will be communicated with the offer.

We reserve the right to cancel or modify promotions if we reasonably believe there has been misuse, fraud, or error.

  1. Intellectual property
All content on the website, including text, images, graphics, logos, designs, and software, is owned by or licensed to BioG and is protected by intellectual property laws. You may use the website and its content only for personal, non‑commercial purposes and may not copy, modify, distribute, or exploit any content without our prior written consent.

  2. Third‑party links and services
Our website may contain links to third‑party websites or services that are not owned or controlled by BioG. We are not responsible for the content, privacy policies, or practices of third‑party websites. Your use of third‑party sites is at your own risk and subject to their terms and conditions.

  3. Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence and for fraud or fraudulent misrepresentation.

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential losses, including loss of profit, revenue, business, or data, arising out of or in connection with your use of the website or purchase of products.

  • Our total aggregate liability to you for any loss or damage arising out of or in connection with the contract shall be limited to the total amount paid by you for the order giving rise to the claim.

  1. Indemnity
You agree to indemnify and hold harmless BioG, its directors, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or your misuse of the website.

  2. Privacy and cookies
Your use of the website and any personal data you provide are subject to our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect your personal data. By using the website, you acknowledge that you have read those policies.

  3. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them or your use of the website shall be governed by and construed in accordance with the laws of [choose: the country where your business is established, e.g. England and Wales, or a specific EU Member State].

The courts of [insert country/jurisdiction] shall have non‑exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or your use of the website. If you are a consumer, you may also be entitled to bring proceedings in the courts of your place of residence under mandatory consumer law.

  1. Online dispute resolution (EU consumers)
If you are an EU consumer, you may have the right to use the EU Online Dispute Resolution (ODR) platform to resolve disputes. The platform is available at: https://ec.europa.eu/consumers/odr.

  2. Changes to these Terms
We may update these Terms from time to time to reflect changes in our business, legal requirements, or website functionality. When we make changes, we will update the “Effective date” at the top and, where appropriate, notify you by email or via a notice on the website.termly+1

Your continued use of the website after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the website and may contact us regarding any existing orders.
